Distance Selling Contract
Article 1 SCOPE
This Distance Sales Contract (“Contract”), including the applications on the mobile device of the BUYER, makes a reservation on the https://istanbultransfertime.com (Website) of the SELLER and the services specified below (“Service”) / Services “) regulates the rights and obligations of the parties regarding the sale to the BUYER and other issues. The BUYER has confirmed this Agreement by clicking on the Website, and the costs and expenses of the services that have been booked are collected by the payment method chosen.

The SELLER and BUYER, which are provided with the above information, will collectively be referred to as the Parties.
Article 3 SUBJECT AND SCOPE OF THE CONTRACT
This Contract has been arranged in accordance with the Law on Consumer Protection No.6502 and the Regulation on Distance Contracts. In this context, the Parties accept and declare that they know and understand their obligations and responsibilities arising from the Law on Consumer Protection and the Regulation on Distance Contracts. This Agreement will not prevent the performance of the provisions in the membership-user agreement and its annexes concluded separately with the SELLER.
Article 4 CONTRACT SUBJECT SERVICE, PRICE, PAYMENT INFORMATION
The type of passenger transfer service, the transfer vehicle and the sales price including taxes are as follows:

Article 5 PROVISION OF CONTRACTUAL SERVICES, EXPENSES AND INVOICE INFORMATION
5.1 The contract is approved and entered into force by the BUYER by clicking on the Website with an open declaration of will. The contract is provided for the SELLER by fulfilling the purchased services according to the passenger transfer details notified by the BUYER. Passenger transfer service will be invoiced for the following information.

5.2 If the SELLER explicitly declares on the Website that the passenger transfer costs will be covered by him, the costs belong to the SELLER. Passenger transfer service is provided after the information notified by the BUYER and the payment is made.
Article 6 PAYMENT OF PASSENGER TRANSFER FEES
6.1 Unless otherwise stipulated by the SELLER, the BUYER must have paid the fee in full before the passenger transfer service is provided. If, for any reason, the PURCHASER does not pay the fee for the passenger transfer service or the payment made is canceled in the bank records, the SELLER shall be deemed to be free from the obligation to deliver the transfer service.
6.2 Buyer’s sales price, credit card, installment card etc. In cases where the card is paid with, all the opportunities provided by these cards are limited to the credit and / or installment payment options provided by the issuing institution. For this reason, service sales, for which the SELLER collects the price in lump sum or incrementally, shall be considered as cash sales by the parties of this Agreement. The statutory rights of the SELLER in cases considered as sales in installments are reserved.
Article 7 RIGHT OF WITHDRAWAL
7.1 The BUYER has the right to withdraw from the contract within 14 days from the date of conclusion of the contract without any justification and without penal clause. This 14 (fourteen) day period starts on the day the contract is signed. In order to use the right of withdrawal, the BUYER must not receive the passenger transfer service and notify the SELLER in writing through the communication channels specified on the site at least 5 hours before the passenger transfer time. After the withdrawal notification of the BUYER reaches the SELLER, the SELLER will share the confirmation information that the notification has been received with the BUYER and return the service fee subject to the right of withdrawal to the BUYER within 14 (fourteen) days. 7.2 In the event that the SELLER fails to fulfill the above-mentioned obligations, the BUYER is not bound by the 14 (fourteen) day period to exercise its right of withdrawal.
Article 8 PAY RESTITUTION
8.1 RETURN OF THE PRICE: If the passenger transfer fee has been collected, the fee will be returned to the BUYER within 14 days in cases of withdrawal in accordance with the legislation and termination of the Contract. The refund is made in accordance with the payment instrument used by the BUYER for passenger transfer fee payment. For credit card payments, the refund process is returned to the BUYER’s credit card. Passenger transfer services fee is refunded to the relevant bank within the same period following the cancellation of the reservation by the BUYER. The transfer of the amount to the BUYER accounts after the refund of the amount to the bank is made by the SELLER is related to the bank transaction process and the SELLER is not responsible for possible delays. The SELLER’s offsetting and discount rights arising from this Agreement and the law are reserved for the amount to be returned.
8.2 REFUND PROCEDURE TO CREDIT CARD: If the BUYER’s shopping is made by credit card and in installments, the credit card refund procedure is as follows:
Payments made with credit cards 1-3 working days payments made with debit cards are refunded 7-14 working days.
If the BUYER purchased the product in installments, the Bank pays the BUYER in installments. After the SELLER pays the entire price of the product to the bank at once, in the event that the installment expenses made from the Bank POS are returned to the BUYER’s credit card, the requested refund amounts are transferred to the credit card holder’s accounts in installments.
Article 9 CONTRACTS WITHOUT RIGHT OF WITHDRAWAL
In accordance with Article 15 of the Distance Contracts Regulation published in the Official Gazette numbered 29188 and dated 27/11/2014, the BUYER cannot use its right of withdrawal in the following cases.
- Contracts for goods or services whose prices vary depending on fluctuations in financial markets and are not under the control of the seller.
- Contracts for goods prepared in line with the consumer’s wishes or personal needs.
- Contracts for the delivery of perishable or expired goods.
- Of the goods whose protective elements such as packaging, tape, seal, package have been opened after delivery; Contracts for the delivery of those whose return is not suitable for health and hygiene.
- Contracts for goods that are mixed with other products after delivery and cannot be separated.
- Contracts for books, digital content and computer consumables provided in the material environment if the protective elements such as packaging, tape, seal, package are opened after the delivery of the goods.
- Contracts for the delivery of periodicals such as newspapers and magazines, except those provided under the subscription agreement.
- Contracts for the use of leisure time for accommodation, goods transportation, car rental, food and beverage supply and entertainment or recreation, which should be done on a specific date or period.
- Contracts for instant services in electronic environment or for intangible goods delivered immediately to consumers.
- Contracts for services started with the consent of the consumer before the right of withdrawal expires.
Article 9 OTHER PROVISIONS
9.1 The BUYER may verbally or in writing her requests, complaints and suggestions regarding passenger transfer service and sales to the SELLER communication channels specified on the website.
9.2 Minors and those restricted cannot shop from the SELLER.
9.3 The Consumer Problems Arbitration Committees and the Consumer Courts where the BUYER or SELLER is located are authorized, within the monetary limits announced by the Ministry of Customs and Trade in December every year in disputes arising from the Agreement established between the parties.
